Tim’s advocacy skills in commercial dispute resolution are broad. He is particularly valued by clients for his ability to consider and analyze problems from their point of view. Tim is committed to finding legal solutions and managing litigation in a way that causes the least amount of disruption to his clients and their businesses. His common sense approach to strategy development and down-to-earth communication style allow him to connect with judges and juries alike.

Tim’s aviation work includes claims involving investigations, accidents, injuries and deaths. His clients include aircraft owners, operators and pilots. Tim has a unique understanding of the regulatory and investigative issues in aviation and has helped clients to develop better practices and procedures to mitigate risk and respond to scrutiny.

For nearly two decades, Tim has served as outside general counsel to the Culver Academies. In this capacity, Tim has worked on matters ranging from commercial contracts to student discipline, premises liability and personal injury matters.

Approachable and able to establish rapport with practically everyone he meets, Tim seeks reasonable compromise where it can be found. The pursuit of justice permeates Tim’s representation of his clients. EXPERIENCE
  • Barnes & Thornburg attorneys handled claims on behalf of the owner of an aircraft involved in a crash in which the pilot and four passengers were killed. All four passenger wrongful death cases were resolved within 12 weeks of the accident – thus sparing the families further trauma. The team then conducted an independent investigation into the cause of the accident, including full-scale reconstruction. The attorneys also appealed the National Transportation Safety Board (NTSB) fault determination through the U.S. Supreme Court and lobbied both administrative agencies and Congress for improved safety regulations.
  • Barnes & Thornburg attorneys represented Venture International, LLC, a business management and executive coaching organization, in a nine-day jury trial in Elkhart County, Indiana, involving claims of tortious interference with an at-will employment agreement and negligence made by a former credit union CEO, who was seeking $1.1 million. The jury returned a complete defense verdict on behalf of our client after an hour of deliberation.
  • Barnes & Thornburg aviation attorneys handled wrongful death and workers’ compensation claims on behalf of a private educational institution’s flight school related to the deaths of two individuals in a plane crash. Cases involving the two decedents were resolved within 12 weeks of the accident.
  • Barnes & Thornburg aviation attorneys have represented multiple clients in Federal Aviation Administration (FAA) investigations involving proposed penalties for alleged violations of Federal Aviation Regulations concerning operational, airworthiness and medical qualification issues, and shipment of hazardous products via air commerce.
  • Barnes & Thornburg pursued the parallel investigation of a fatal aircraft accident which killed the only person on the plane, the pilot. We vetted the National Transportation Safety Board (NTSB) determination of cause and advised client as to pursuit of defective design claim against the manufacturers of the airframe and major subsytems.
  • Barnes & Thornburg represented a consortium of aircraft owners targeted by an FAA Special Emphasis Investigation Team (SEIT) investigation concerning ownership and operational structures.
  • Barnes & Thornburg represented pilot/owner in defense of administrative investigation and proposed penalty resulting from in-flight emergency. A satisfactory settlement was reached with the FAA.
  • Barnes & Thornburg successfully represented the owner of a restored warbird in response to FAA’s emergency revocation of its airworthiness certificate. We obtained the dismissal of charges concerning airframe time and airworthiness certification issues, so the warbird could fly once again.
  • Barnes & Thornburg successfully resolved a wrongful death claim arising from the fatal crash of an ultralight aircraft.
  • Days before the November 2008 election, the plaintiff sought an injunction preventing an issue from going on the ballot regarding the removal of the local water utility from the jurisdiction of the Indiana Utility Regulatory Commission. The trial court denied the injunction and dismissed. Manigault v. St. Joseph Election Board et al.
  • Tim Maher has served as outside general counsel since 2003 for a private college preparatory boarding school addressing a variety of issues relating to students, faculty, alumni and visitors; Indiana High School Athletic Association matters; aviation matters; IT infrastructure and contracts; athletics and team agreements; contracts and logistics pertaining to school group performances and travel; and personal injury and breach of contract matters.
