Steve L. Hernández Partner
Steve’s labor and employment law experience is deep, and includes hiring, discipline and discharge; handling grievances, wage and hour and equal opportunity disputes; HR audits, executive compensation and employment agreements; personnel policies and procedures, employee handbooks, ADA accommodations and FMLA leave; non-competition and trade secrets; and employee health and safety. Steve advises on the laws and regulations that permeate labor and employment practices, such as the Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Family and Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA) and federal and California Worker Adjustment and Retraining Notification Act (WARN), among others.
Steve consistently delivers practical solutions that help clients to cultivate, rather than disrupt, constructive employee relations. A traditional labor lawyer, Steve works diligently with non-union clients to remain union free, as well as assists unionized workforces to manage their operations as efficiently as possible. He advises on union elections and representation proceedings before the National Labor Relations Board (NLRB), labor agreements, grievances and arbitrations, decertification proceedings and strikes, lockouts and picketing.
Notably, Steve brings years of experience as an attorney with Region 21 of the National Labor Relations Board (NLRB) to his practice. While at the NLRB, Steve investigated unfair labor practices, litigated unfair labor practice complaints, conducted union representation elections, and presided over NLRB proceedings as a hearing officer.
Successful dispute resolution is at the center of Steve’s practice. He defends employers before administrative and arbitral forums, in state and federal court, and before civil rights agencies throughout California and across the country. He has resolved difficult, emotionally charged disputes and complex litigation involving discrimination, harassment, retaliation, whistleblower and unfair competition, wrongful termination, and wage and overtime actions. Steve aggressively defends employers involved in labor injunctions, unfair labor practices charges, defamation and WARN act litigation.
Prior to joining the firm, Steve worked at a well-regarded plaintiff’s firm in Los Angeles, so he understands how plaintiff’s lawyers tend to think about cases and react in litigation. This experience helps Steve’s clients potentially avoid litigation and, where litigation cannot be avoided, achieve the best possible cost-effective outcome.
Collaborative, responsive, thoughtful and pragmatic, Steve is committed to achieving results that provide his client with the most favorable conclusion imaginable under often difficult circumstances. A true people person who puts the needs of his clients first, Steve encourages the conservation of resources at every turn, heading off disputes before they can snowball into obstacles and creating policies and procedures that support rather than hinder progress.
