Complex commercial litigator Mike Gottschlich resolves major business, antitrust, lender, securities and director and officer liability disputes and claims. Mike is about getting results for clients. A dynamic negotiator, Mike is known for his ability to see the many different perspectives and angles of a dispute in order to identify and promote the right argument on his client’s behalf.

As national counsel for several companies involved in complex business litigation in both federal and state courts throughout the country, Mike’s work focuses on the representation of financial institutions. Mike also represents individual corporate directors and officers in malfeasance, antitrust and securities litigation. Recently, Mike worked with directors of stressed and failed banks in claims brought by shareholders and/or the FDIC.

He also assists lending and other financial institutions in mortgage fraud recovery. Mike represents virtually every type of entity up and down the mortgage lending chain, from initial funding to warehouse lenders to investors in the secondary market. He has assisted such clients in seeking and receiving significant recoveries against brokers, appraisers, borrowers, title companies and others involved in the loan transaction. In addition, he defends banks in Truth in Lending Act (TILA) and Real Estate Settlement Procedures Act (RESPA) claims.

While in California and prior to joining the firm, Mike tried a number of complex cases involving commercial and securities fraud. He also resolved contract disputes and professional malpractice claims.

EXPERIENCE
  • Barnes & Thornburg represented defendant officer in action regarding bond offerings and securities fraud. On appeal, the court affirmed the district court's dismissal of the complaint against our client based on the statute of limitations.
  • Represent numerous officers and directors of distressed banks and other lending institutions in indemnity claims brought by the FDIC alleging mismanagement, breach of fiduciary duty, and gross negligence. In addition to representing the directors and officers, attorneys also assist in analyzing and securing insurance coverage for these individuals regarding the FDIC claims.
  • Represented corporate officer in appeal of lower court's ruling in securities fraud and breach of fiduciary duty claims;
