9:45 - 10:30 a.m. Construction Defects – The Threshold “Occurrence” Issue
State law continues to evolve and remains divided as to whether a construction defect claim constitutes an accidental “occurrence” that potentially triggers insurance coverage under the commercial general liability policy. This presentation will discuss the history and current status of this critical aspect of insurance coverage for construction defect claims, and attendees will receive a 50-state survey of state law on this important topic. The presentation will also discuss other current issues regarding insurance coverage for construction defect claims, and how alternative dispute resolution procedures can be used to resolve construction defect claims.
10:30 - 11:15 a.m. Claims Convergence – Professional Liability or General Liability
Construction claims today are becoming more complicated, particularly with a variety of delivery methods and blurring of responsibilities for design within certain methods (design assist, design/build, IPD, CM at risk). Claims can straddle both General Liability (GL) and Professional Liability (PL) policies and require first- and third-party coverages. This discussion will center on awareness of this convergence, coverage to address the risk, and best practices to protect you in the event of such a claim.
