Andrew Detherage is the firm managing partner and serves as chair of the firm's Management Committee and chair of its Strategic Planning Committee. He formerly served as co-chair of the firm's Insurance Recovery and Counseling Practice Group, which was named by Law360 as a 'Practice Group of the Year.'

Andrew Detherage is the firm managing partner and serves as chair of the firm's Management Committee and chair of its Strategic Planning Committee. He formerly served as co-chair of the firm's Insurance Recovery and Counseling Practice Group, which was named by Law360 as a 'Practice Group of the Year.'

Andrew represents clients in litigated matters throughout the United States and has appeared in courts in more than 35 states. His practice concentrates on insurance coverage matters for policyholders, complex commercial disputes, and toxic torts defense. He currently serves as national counsel for clients in sophisticated insurance coverage litigation, commercial litigation, and toxic tort matters.

For more than 25 years, Andrew has served as national counsel for numerous clients in insurance coverage matters, commercial litigation, toxic tort litigation and mass tort litigation. In particular, in 2015, he represented a global leader in retail real estate ownership, management and development and secured a $204 million jury verdict after a six-week trial relating to flood losses. The verdict included both covered losses and consequential damages in excess of the coverage limits.

Andrew has been ranked among the top litigation attorneys since 2011 in Chambers USA. In 2011, Andrew was named a Fellow of the Litigation Counsel of America. In 2015, he was recognized as a Law360 MVP for his work in insurance litigation. He has written papers and spoken at seminars on insurance coverage, expert witnesses, and trial preparation. 

Andrew is a native of Indiana, and he continues to be active in and is dedicated to the Indianapolis community in which he lives and works.

  • Led a team representing Simon Property Group, a global leader in retail real estate ownership, management and development, and won a $204 million jury verdict after a six-week trial in Nashville, Tenn. The trial related to flood losses that occurred in May 2010 at the Opry Mills mall in Nashville, which involved 17 insurers who refused to pay for losses above the first $50 million layer of coverage. The verdict included both covered losses and consequential damages in excess of the coverage limits and followed a favorable summary judgment ruling in March 2015 in which the court ruled that up to $200 million in coverage was available for the loss. The case had been pending for five years and involved more than 130 depositions, including more than 20 experts, along with dozens of motions for partial summary judgment and motions in limine, and a successful effort to defeat a motion to compel appraisal. 
  • Successfully defended a national homebuilder in a two week trial in Denver, Colorado. The plaintiff sought $30 million in damages including RICO claims.
  • Secured a $12 million verdict for an Indiana utility in a case involving trade secret claims and breach of contract counterclaims, after a three week jury trial. Also secured and a defense verdict for the utility on the defendants’ counterclaims.
  • Won a defense verdict for a national homebuilder after a one week jury trial where the plaintiff sought damages arising out of a real estate transaction and an alleged exposure to mold
  • Obtained a preliminary injunction for Simon Property Group against Starbucks enjoining Starbucks from closing its Teavana stores and enforcing the “continuous operations” clause in the parties’ leases
  • Successfully defended a Fortune 50 client in a dispute over a nine figure indemnity obligation in an asset purchase agreement. The case was filed in Boston and involved a complex contract interpretation under New York law, and unique usage of trade and complex expert issues. Won two summary judgments and successfully defended those summary judgments on appeal,
  • Successfully defended a class action against a national homebuilder involving thousands of homes. After resolving the class action claims, he led a team of Barnes & Thornburg lawyers in a recovery action against more than 40 subcontractors. In that action, we recovered more than $20 million in damages.
  • Represented a major manufacturer in a major insurance recovery claim arising out of a devastating flood, against a group of property insurers. After years of litigation, the firm secured a nine figure settlement for its client.
  • Represented owners of a high rise office building in an eight-figure claim to recover costs of substantial repairs to the structure caused by storm damage, securing a mid-eight figure settlement
