Barnes & Thornburg Helps Clear Patent Charges Against OFS Fitel

A May 8 final determination by the United States International Trade Commission cleared OFS Fitel, LLC, a manufacturer of optical fiber products, of charges that it violated section 337 of the Tariff Act of 1930, as amended.

OFS, based in Norcross, Georgia, was alleged to have infringed four U.S. patents owned by Dutch holding company DSM IP Assets B.V. pertaining to optical fiber coatings and optical fiber made with those coatings. The ITC’s opinion found all asserted patent claims invalid.

“We are extremely pleased with the Commission’s opinion,” said Jordan Weinstein of Barnes & Thornburg. “Our client OFS has a legacy of innovation, dating back to Alexander Graham Bell. That innovation played a crucial role in the ITC’s decision vindicating OFS.”

The Barnes & Thornburg team representing OFS was Jordan Weinstein, Bradley J. Olson, Scott Godes, Brad Love, Christine Sohar Henter, Regina Murphy, Scott Rothenberger, Eddie Ayoob, and David Spooner.

OFS is a global provider of coated optical fiber and cabling with facilities in Georgia, Connecticut, New Jersey, and Massachusetts, as well as in Europe and Asia.

With more than 600 attorneys and other legal professionals, Barnes & Thornburg is one of the largest law firms in the country. The firm serves clients worldwide from 14 offices in Atlanta, Chicago, Dallas, Delaware, Indiana, Los Angeles, Michigan, Minneapolis, Ohio, San Diego, and Washington, D.C.
