Independent Counsel

David Wood and Matthew O’Hanlon will discuss independent or Cumis counsel issues affecting policyholders in all states, with special attention to California. They will identify situations that give rise to a potential right to independent counsel, highlight the concerns that policyholders should consider when deciding whether to insist on independent counsel, and explain how different states resolve whether a right to independent counsel exists. Additionally, we will share commentary on the statutory provisions governing the appointment of independent counsel—including with respect to selection, qualification, and duties—and discuss issues relating to insurers’ duty to pay for independent counsel.

Insurance Company Outside Counsel Guidelines and Rates

Kari Jackson and Charlie Edwards will identify problematic provisions in insurance company outside counsel guidelines. They will discuss the applicability and effect of such guidelines on outside counsel representation and malpractice coverage. They will also offer tips for negotiating outside counsel guidelines with insurance carriers to avoid unreasonable burden.

Privilege and Work Product

Andy Detherage and Kara Cleary will help you understand the sometimes complicated privilege and work product nuances in the context of insurance coverage disputes. This section of the webinar will review the basics about the attorney-client privilege, common interest and waiver doctrines. We will then examine how these doctrines come into play in a coverage dispute when working with your broker, in-house counsel, insurer-appointed defense counsel in an underlying matter and with your insurance company after a reservation of rights or denial.
