Rights of Publicity

Various state statutes protect the use of a person's name, voice, or likeness from being used for a commercial purpose without the consent of the person involved. Indiana is one such state, with a statute that protects even persons who have died. California is another such state, and the list includes a number of others. The most senior lawyer in our Rights of Publicity group was the principal drafter of the Indiana Right of Publicity Statute.

The lawyers of Barnes & Thornburg LLP have helped:
  • Protect such rights when the person has not authorized the use; and
  • License such rights when the person has given authorization
They have represented numerous individuals, alive and dead, including:
  • James Dean
  • Babe Ruth
  • John Dillinger
  • Bill Elliott
  • Marilyn Monroe
  • Humphrey Bogart
