Paul M. Drucker is a partner in Barnes & Thornburg LLP’s Indianapolis and Chicago offices and a member of the firm’s Environmental Law Department, which was recently recognized as Tier 1 for national environmental litigation and environmental law in the annual "Best Law Firms" ranking by U.S. News and Best Lawyers. He is the Practice Leader of the firm's Pipeline Practice Team and is also a member of the water law team and the firm’s Litigation and Appellate Departments. Prior to joining Barnes & Thornburg, Mr. Drucker practiced environmental law and complex commercial litigation at Mayer Brown LLP in Chicago.

The firm's Pipeline Practice Team is a multidisciplinary group of attorneys capable of handling the full range of pipeline and refinery-related issues in the Midwest and beyond. As the Practice Leader of the Pipeline Practice Team, Mr. Drucker advises major oil companies and pipeline operators regarding pipeline siting and installation, integrity management issues, pipeline safety regulations, leak response, crisis management, environmental remediation, and investigations into pipeline incidents. In this regard, he interacts with PHMSA, EPA and other state and federal regulatory authorities regarding response activities, legal claims, and environmental impacts arising from pipeline failures. Mr. Drucker structures and conducts internal investigations, manages and resolves third-party claims, and advises pipeline operators regarding pipeline failure analysis investigations and pipeline restart plans. He is conversant with in-line-inspection processes, leak detection systems, cathodic protection, pipeline coating methods, pressure test protocols, control room management, and related issues. Mr. Drucker and the Pipeline Practice Team also have substantial experience in major oil refinery operations and frequently provide counsel on regulatory compliance issues, enforcement actions, permitting, risk review and mitigation, oil release and crises management situations, and incident investigations.

Mr. Drucker has broad experience representing corporate clients in complex commercial and environmental litigation and arbitration matters. He has significant experience in motion practice, including dispositive motion writing and oral argument, in state and federal courts throughout the country. He has demonstrated success in moving to strike proffered expert opinions for failure to meet Rule 702/Daubert requirements and conducting evidentiary hearings in federal court. His federal court experience also includes obtaining prejudgment remedies, including asset attachments and temporary restraining orders, examining witnesses on the stand, and defending judgments on appeal. On the commercial litigation front, he has handled numerous contract, product liability, fraud, toxic tort and related matters. With respect to environmental litigation, he has represented clients in cases involving CERCLA, RCRA, CWA, CAA and other federal and state statutes in a variety of different venues. Mr. Drucker regularly drafts federal appellate briefs regarding complex issues and was the principal author of a Petition for Writ of Certiorari to the U.S. Supreme Court concerning Clean Water Act issues that received national media attention. As part of the firm’s water law team, Mr. Drucker works with municipal waste water treatment plants in various jurisdictions on complex compliance and litigation issues.

Mr. Drucker also advises major corporations on environmental, health and safety issues in regional, national and international business transactions, including mergers, acquisitions, stock purchase agreements, divestitures and real estate transactions. He frequently manages environmental due diligence, oversees environmental investigations and negotiates environmental provisions in transaction documents. Mr. Drucker has been involved in a number of high-profile multimillion and multibillion dollar transactions. He has also served as a guest lecturer on Environmental Issues in Corporate and Real Estate Transactions for the M.B.A. program at Northwestern University’s Kellogg School of Management and for the Master of Architecture Graduate Program at Illinois Institute of Technology.

For his pro-bono work, Mr. Drucker has successfully represented cancer patients in need of bone marrow/stem-cell transplantation. He has obtained reversal of coverage decisions for cancer patients whose health insurance providers had denied coverage for such transplants by claiming that the treatment was "experimental or investigational" or "not medically necessary," among various other justifications.

Mr. Drucker received his B.A. from the University of Kansas in 1995. He earned his J.D. in 1999 from DePaul University College of Law, where he was a Dean’s Scholar scholarship recipient all three years and was on the Dean’s List. In 2002, he received his LL.M. concentrating in environmental law, with Distinction, from Georgetown University Law Center, where he also earned a CALI Award for best paper in Natural Resources Law Seminar.

Mr. Drucker is admitted to practice in the states of Illinois and Indiana; the U.S. District Courts for the Northern District of Illinois, the Northern District of Indiana, the Northern District of Ohio and the District of Colorado; the U.S. Courts of Appeals for the 6th and 7th Circuits; and the U.S. Supreme Court.
