Student Disability

Our Higher Education and School Law Practice Groups have significant experience in representing schools in student disability matters. We represent public and private schools from the elementary to the collegiate level in numerous courts and administrative settings with matters such as:

  • Disputes arising under Section 504 of the Rehabilitation Act and the Americans with Disabilities Act;
  • Complaints to the Office of Civil Rights;
  • Due process hearings brought pursuant to the Individuals with Disabilities Education Act (IDEA) and subsequent appeals to federal court; and
  • Complaints to the Department of Education’s Center for Exceptional Learners.

We also provide client counseling, conduct compliance audits, develop and revise policies to comply with best practices, and train personnel on a variety of topics, including eligibility matters, due process hearing avoidance, manifestation determinations and resolution sessions.
