Jason A. Bernstein is a partner in the Atlanta office of Barnes & Thornburg LLP, where he is a member of the firm’s Intellectual Property Department.

For more than 25 years, Mr. Bernstein has developed his practice to include a broad range of issues in the intellectual property (IP) arena, including patent, trademark, software and copyright law, as well as related business matters. He concentrates his practice on the preparation and prosecution of patent, trademark and copyright applications in the U.S. and abroad, and advising clients with respect to IP law and strategy.

Mr. Bernstein’s experience includes creating licensing agreements, counseling clients in infringement disputes and licensing negotiations, and providing strategic planning advice designed to increase clients’ protectable technology and brand portfolios. He assists in the management of these portfolios and develops licensing opportunities for enhanced revenue generation. Additionally, he has been involved in strategic IP planning and due diligence investigations related to merger and acquisition transactions.

Mr. Bernstein has counseled startup and established technology companies as well as universities in various fields, including medical devices (catheters, wound closure devices, optical coherence tomography imaging, surgical implants and operating devices, and other technologies), organic chemistry, polymers (including nonwoven materials and contact lenses), pharmaceuticals, microencapsulation of biologics, monoclonal antibodies, immunoassay diagnostic methods and devices, immunology, software, business methods, and, mechanical apparatus and methods.

Prior to joining Barnes & Thornburg, Mr. Bernstein was a partner with Bryan Cave Powell Goldstein in Atlanta, GA. In addition, he has been the founder and managing partner of an IP law firm, director of multifocal lens technology for Ciba Vision Corporation, patent and general counsel for medical device and diagnostics manufacturer Murex Corporation, and has also worked as a patent attorney in the law firm environment. Additionally, he worked in Germany during college performing chemistry research under a grant from the German government.

Mr. Bernstein is co-inventor on U.S. Patent Nos. 6,855,424; 6,834,762; and D473,113. He has been a guest lecturer at several universities, including Mercer University, University of Georgia, Georgia Institute of Technology, Kennesaw State University and the Art Institute of Atlanta.

He earned his B.S. in chemistry from Vanderbilt University in 1980 and his J.D. in 1983 from the University of Miami. He is admitted to practice in the states of Georgia and Florida and also to the patent bar.

Mr. Bernstein is a member of the Intellectual Property and General Practice Sections of the American Bar Association. He also is a member of the American Intellectual Property Law Association, Atlanta Bar Association, International Trademark Association, Technology Association of Georgia and Product Development & Management Association. Additionally, he is a member of the State Bar of Georgia’s Technology Law Section and the Intellectual Property Section of which he served as chair from 1999-2000.

He is AV-rated by Martindale-Hubbell and was recognized in 2003 and 2008 by Georgia Trend magazine as one of the Georgia Legal Elite attorneys.

Mr. Bernstein is active in the community as a member of the Atlanta Symphony Orchestra board of directors and nominating committee, HealthMPowers, Inc. board of directors, Dad’s Garage Theatre Company advisory board and member of the Georgia Volunteer Lawyers for the Arts. He has also been the chairman of the Intellectual Property Section of the Georgia Bar.
