Daniel P. Albers is a partner in the Chicago office of Barnes & Thornburg LLP. He practices in the Intellectual Property and Litigation Departments, concentrating in the areas of intellectual property, patent infringement, commercial litigation and appeals.

Mr. Albers regularly represents clients in actions throughout the Midwest. Such representations include individuals, public governmental entities, utilities and banking institutions. He has litigated a broad range of disputes for both plaintiffs and defendants including patent, trademark, copyright and trade secret infringement, ERISA, asbestos removal, CERCLA liability, environmental issues, insurance defense, securities fraud, antitrust and contract disputes. Mr. Albers has prepared and tried a variety of patent cases, both in Federal Court and in arbitration.

Mr. Albers argued the landmark ERISA preemption case, Moran v. Rush HMO in the United States Supreme Court, establishing the right to independent medical review of insurance medical necessity decisions. He regularly represents Hewlett-Packard Company. He recently represented a Hewlett-Packard company in a coverage dispute arbitration related to the software design services for the New York City 911-system. He served as lead counsel and liaison counsel for the Board of Education in its suit to recover the costs of asbestos abatement in the Chicago public schools.

Mr. Albers was recognized by The Best Lawyers in America since 2013 and Illinois Super Lawyers since 2014 for his work in patent law. He has an AV Preeminent rating from Martindale-Hubbell. He has also lectured and written on subjects such as mandatory arbitration, products liability, third-party practice, and medical malpractice.

Mr. Albers is a native of Elmhurst, Ill. He graduated from the University of Illinois with a B.S. in biology in 1980. He received his J.D. in 1983 from the University of Illinois College of Law. He is admitted to practice before all Illinois state and federal courts, the United States Courts of Appeals for the Seventh and Federal Circuits, the United States Supreme Court, and the United States Patent and Trademark Office. He is a member of the Million Dollar Advocates Forum and a Commercial Panel and Uninsured Motorists Panel Arbitrator for AAA.
